Eligibility & reporting.

All PAC contributions must be made by individuals. Contributions may be accepted from individuals, sole proprietorships, partnerships, and other PACs. Corporations may not fund TMBPAC. Contributions are public record and reported to the Texas Ethics Commission. Contributions are not deductible as business or charitable expenses.

TMBA has a record of working with lawmakers, regulators, and allied industry organizations to improve legislation, prevent unintended consequences, and protect the ability of mortgage lenders and servicers to serve Texas consumers.

  • Remote Online Notarization

    A bill was passed to authorize and establish procedures for remote online notarization of “wet ink” signatures. TMBA collaborated with title company colleagues to help maintain safeguards in Texas online notary law and use definitions consistent with other law.

  • Releases of Lien

    TMBA helped clarify penalty provisions of a new law requiring mortgage servicers to file releases of lien within specific time periods after payoff, avoiding harsher penalties for technical violations.

  • Reverse Mortgage Advertising

    TMBA opposed HB 2632 related to reverse mortgage advertising because the bill proposed unworkable and subjective standards. The bill did not move.

  • Homestead Conveyances

    TMBA supported passage of HB 207, which excluded certain homestead conveyances from the definition of a “pretend sale,” helping preserve the validity of transactions made prior to enactment.

  • Local Regulation of Mortgage Lending

    TMBA supported HB 2127, which prohibited local governments from passing ordinances governed by the Finance Code, helping prevent local regulation of mortgage origination and servicing.

  • Foreign Ownership of Texas Real Estate

    TMBA opposed several bills restricting foreign ownership of Texas real estate due to constitutional and fair housing concerns.

  • Technical Finance Code Violations

    TMBA advocated amendments to HB 4635 related to organized crime to prevent unjust prosecution for technical violations of the Finance Code.
